TERMS OF CONTRACT AND SALE
THE FOLLOWING CONDITIONS ARE CONSIDERED TO BE READ AND ACCEPTED IN FULL BY EACH PARTICIPANT AT THE TIME OF BOOKING.
SELF-DECLARATION
Every participant intending to take part to the excursions/activities described on this web site, upon completion of the reservation formalities, with the declaration of acknowledgment and acceptance of the contract terms attests their medical fitness, with absence, then, of injurious pathologies, in the knowledge of the implied physical effort and of the possibility of severe and/or demanding conditions, caused by the weather and/or the altitude. Every participant says he is aware of the objective and subjective dangers on the mountain and of mountaineering. Every participant says also he knows that those dangers are not impaired if he is accompained by a MOuntain Guide. The participant declares also he will follow all the instructions of the Mountain Guide and he assumes all the responsibility for every action done on his own initiative.
ECONOMIC TERMS
The rate includes:
– The Mountain Guide service
– The Mountain Guide third-party liability insurance
– The use of the shared safety equipment
The rate does not include:
– Personal insurance
– The rental of personal equipment (the rates are indicated in the equipment list, which can be downloaded from every outing)
– Any transport, food, accommodation and cable car/lift costs, for the participants and the Mountain Guide
– Everything not explicitly mentioned under “The rate includes”
RESERVATION, COMPENSATION, WITHDRAWAL AND CANCELLATION
– For reservations with 60 or more days in advance:
The payment by bank transfer or credit card of a security deposit is required, pursuant to and for the purposes of Article 1386 c.c., amounting to 75% of the full amount. This deposit can be entirely returned in case of withdrawal with more than 60 days in advance with respect to the planned date of the outing. If the withdrawal happens with 60 to 30 days in advance, 50% of the deposit will be returned. In case of withdrawal with less than 30 days in advance with respect to the outing/activity date, the deposit will not be returned. The balance must be paid in cash to the Mountain Guide.
– For reservations with 60 to 30 days in advance:
The payment by bank transfer or credit card of a security deposit is required, pursuant to and for the purposes of Article 1386 c.c., amounting to 75% of the full amount. 50% of this deposit can be returned in case of withdrawal with 30 or more days in advance. In case of withdrawal with less than 30 days in advance with respect to the outing/activity date, the deposit will not be returned. The balance must be paid in cash to the Mountain Guide.
– For reservations with less than 30 days in advance:
The payment by bank transfer or credit card of a security deposit is required, pursuant to and for the purposes of Article 1386 c.c., amounting to 75% of the full amount. This deposit can’t be returned. It is noted that the reservations with less than 15 days in advance are the most prone to non-acceptance from the organisation, since it is likely that all our Mountain Guides will be busy.
– Courses, workshops and collective trips:
At the time of the reservation, you will be asked to pay via bank transfer or credit card the total amount for participant. This deposit will be returned exclusively if the course/workshop will be cancelled by the Mountain Guide.
N.B.: In some cases, for organizational reasons, you will be asked to pay the confirmation deposit directly to the Mountain Guide. For this reason, some payment methods integrated on our site refer to current accounts held in the name of Mountain Guides with whom we collaborate.
In case the outing and/or the course/workshop are cancelled by the Mountain Guide because of adverse weather conditions or mountain conditions unsuitable to the activity, you can choose to:
– Have 100% of the paid amount returned, security deposit included.
– Reschedule the same outing for a different date, which in any case cannot be later than 60 days after the initially scheduled date.
– Choose a different outing, which will be proposed to you by the Mountain Guide. In this case, if the outing price is less than the already paid amount, the difference will be returned. Vice versa, you will be required to supplement the paid amount if the new outing price is higher.
INSURANCE/LIABILITY
During the activities, every participant is covered by the third-party liability insurance of the Mountain Guide, who is the sole person liable for the activity. This insurance covers the clients exclusively for the possible damages suffered because of negligence and/or errors committed by the Mountain Guide.
It is recommended to have a personal accident insurance.
It is noted that the sole liable person during the entire course of the activity is the Mountain Guide that was assigned to you or that you chose, without prejudice to the obligation for the participants to show up in suitable psychophysical conditions and to avoid any negligence and/or imprudence against which the Mountain Guide is unable to react promptly.
PROGRAM VARIATIONS DURING THE ACTIVITY
The Mountain Guide, as the sole liable person during the whole activity, is the only person having the power to assess if there is any need to modify the program during the outing. He can therefore decide to stop the activity or to modify the route and/or the destination at any time, after evaluating the weather conditions, the mountain conditions and the psychophysical conditions of the participants. In case the activity underwent such variations or was interrupted during its course, no refund will be made.
JURISDICTION AND COMPETENCE. In case disputes or litigations occur, the Italian jurisdiction will be applied and the Court of Aosta will be conventionally competent, namely the competent courts included in the relevant district (Court of Aosta and Justice of Peace of Aosta).
